Technology could also be leveraged to identify online behavior patterns predictive of real-world risks. With further research and resources, platforms may gain new tools to curb extremism before it manifests offline.
Legal Approaches and Challenges
When monitoring fails to prevent criminal plans or activities, legal prosecution remains an option. However, jurisdictional issues arise when offenses occur partially or entirely online and cross international borders. Prosecuting online hate speech also involves balancing free expression rights with public safety—a challenge considering extremist rhetoric may not qualify as a direct incitement to violence based on current laws (Comparitech, 2022).
Some jurisdictions have expanded their legal definitions of hate crimes and terrorist incitement to encompass online activity. Others propose new regulations to hold platforms accountable if they do not sufficiently police such content on their services.
