Instant Offense:
Benny Smith, together with John Doe and Jack Daniels were caught committing
armed robbery in a jewelry store on October 2, 2007.(Burglary)
It is established that Benny suffers
from instability and considerable negative mental effect. The effect is chronic.
Offenders’
Version:
Benny Smith pled guilty to the armed robbery and accepted to have threatened
the store keeper with a gun. He had a wife, who was threatening to leave him,
and two children, and no money to take care of her. He just needed to help
his family. He meant no harm, he only needed money.
Benny Smith is characterized by long
history of drug abuse alongside with connection to drug cartels in Ohio.
This history dates back to his early
age where he was convicted and sentenced for 2 years by a juvenile court.
It is also established that due to
this long history of drug abuse, he has severely experienced negative mental
health effects. According to the Dr. J.M Bruce, Benny got addicted to various
drug classified as Hallucinogens at his early ages.

action of Mr. Benny Smith have greatly affected my life; Since he committed
the crime I have been unable to live comfortably due to fears that he may
come and injure me again. I am unable to interact with people like it used to
be before. My children are also in constant fear.
I
have suffered heavy financial losses due to items that he stole from me. As a
family we have suffered psychologically and our medical bills have grown over
time. My financial and psychological effect will be felt for many years to
come. I know this is not the first time he has appeared before a court of law
and it’s the time that he is held accountable for his actions.

the offender Benny Smith, I would recommend a three-year jail term and
propose that the offender goes through a program of reentry initiative
during
that period. The reentry Initiative program essentially helps
incarcerated violent offender to transition back to their neighborhoods
so as to peacefully coexist with the community following release from
jail through mentoring, social service assistance and
vocational development. Well, the offender had gotten a high risk to
the community since from the previous criminal record it shows that
Benny Smith has been involved in criminal activities before and has been
jailed for two years. In essence, the offender
has a high risk to the community because of a higher probability of
reciprocating. Recidivism refers to the process of going back to a
previous behavior, especially a criminal behavior, even after going
through the correction programs.
Well,
a community correction plays a vital role in creating positive change
in the rehabilitation process of offenders. Not only does it deal with
those who have been placed under supervision before incarceration, but
they also deal with those who have recently been released from prison.
The main purpose of community correction is successfully helping the
offenders to reintegrate back into the society
and reduce the risk of returning to the criminal activities. Risk
principle encourages that it is very important to invest resources in
people who necessarily need the help. For instance, it would be
uneconomical and imprudent to invest resources in people
with a low risk of recidivism. A placing of a low-risk offender in more
structured programs is likely to fail and reduce the effectiveness of
the program. Regarding the treatment principle, correctional programs
should always target risk and need factors,
thus they should be behavioral in nature.
